Acceptance of Terms
Welcome to Pixie Dust CRM. These Terms of Use ("Terms") constitute a legally binding agreement between you and Pixie Dust CRM ("we," "us," or "our") governing your access to and use of our web application, mobile applications, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Eligibility
You must be at least 18 years of age and capable of forming a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements. If you are using the Service on behalf of a business or agency, you represent that you have authority to bind that entity to these Terms.
Account Registration
To access the Service, you must create an account by providing accurate, current, and complete information. You agree to:
- Maintain the security and confidentiality of your login credentials.
- Immediately notify us of any unauthorized use of your account.
- Accept responsibility for all activities that occur under your account.
- Keep your account information accurate and up to date.
We reserve the right to suspend or terminate accounts that contain inaccurate information or that violate these Terms.
Service Description
Pixie Dust CRM is a customer relationship management platform designed for independent travel advisors and travel agencies. The Service includes, but is not limited to:
- Client management and contact organization.
- Trip and booking management.
- Itinerary creation and sharing.
- In-app messaging between advisors and clients.
- Payment tracking, invoicing, and card authorization processing.
- Document storage and sharing.
- Email and SMS communications.
- Website embeddable quote request forms.
- Agency management and team collaboration tools.
Subscriptions and Payment
Plans and Billing
Access to the Service requires a paid subscription. Subscription plans, pricing, and included features are described on our pricing page and may be updated from time to time. By subscribing, you agree to pay all applicable fees.
- Subscriptions are billed on a recurring basis (monthly or yearly) through Stripe.
- All fees are stated in U.S. dollars and are non-refundable except as required by applicable law.
- You authorize us to charge the payment method on file for recurring subscription fees.
Free Trials
We may offer free trial periods at our discretion. At the end of a trial, your subscription will automatically convert to a paid plan unless you cancel before the trial expires. We will notify you before any charges are made.
Cancellation
You may cancel your subscription at any time through the Service or by contacting us. Upon cancellation, your access continues through the end of the current billing period. We do not provide prorated refunds for unused portions of a billing cycle.
Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:
- Use the Service for any unlawful, fraudulent, or harmful purpose.
- Upload or transmit viruses, malware, or any other malicious code.
- Attempt to gain unauthorized access to the Service, other accounts, or our systems.
- Interfere with or disrupt the integrity or performance of the Service.
- Scrape, crawl, or use automated means to access the Service without our written consent.
- Use the Service to send spam, unsolicited marketing, or messages that violate applicable anti-spam laws.
- Resell, sublicense, or redistribute access to the Service without our authorization.
- Store or transmit content that infringes on any third party's intellectual property or privacy rights.
Client Data and Advisor Responsibilities
Travel advisors who use the Service to manage client information acknowledge and agree that:
- You are the data controller for client data you enter into the Service. We act as a data processor on your behalf.
- You are responsible for obtaining any necessary consents from your clients before entering their personal information into the Service.
- You must comply with all applicable privacy laws and regulations when collecting, using, and sharing client data through the Service.
- You will not enter sensitive personal information (such as Social Security numbers, government IDs, or medical records) into free-text fields not specifically designed for that purpose.
Card Authorization Forms
The Service provides a credit card authorization form feature that allows travel advisors to collect payment card details from clients. Card data submitted through authorization forms is encrypted end-to-end using Evervault and transmitted directly to the processor — no card data is stored on our servers at any point. Viewing card authorization details requires multi-factor authentication. Authorization forms expire automatically after 48 hours. You agree not to attempt to circumvent these security measures or store card data outside the Service.
Communications
The Service enables advisors to communicate with clients via in-app messaging, email, and SMS. By using these features, you agree to:
- Comply with all applicable laws governing electronic communications, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and all applicable state and federal regulations.
- Obtain proper, documented consent from clients before sending SMS messages. The Service provides a built-in opt-in mechanism for clients; advisors must not bypass this mechanism or add phone numbers to SMS lists without explicit client consent.
- Use messaging features only for legitimate, transactional communications directly related to travel bookings and services.
- Not use the messaging features for unsolicited marketing, promotional messages, or communications unrelated to travel services.
- Honor all opt-out requests promptly. When a client replies STOP or opts out via Settings, no further SMS messages may be sent to that client.
SMS Messaging Terms
SMS messaging through the Service is subject to the following terms:
- Opt-in required: Clients must explicitly opt in to receive SMS messages through the in-app opt-in dialog or Settings toggle before any SMS messages can be sent. Opt-in is voluntary and not required for any purchase or service.
- Transactional messages only: SMS messages sent through the Service are limited to transactional communications, including payment reminders, booking confirmations, trip updates, and responses to client inquiries. Promotional or marketing SMS is prohibited.
- Message frequency: Message frequency varies based on trip activity, typically 1–10 messages per month.
- Costs: Message and data rates may apply. The Service does not charge clients for receiving SMS messages, but carrier rates may apply.
- Opt-out: Clients can opt out at any time by replying STOP to any message, toggling off SMS in app Settings, or contacting us at jeff@pixiedustcrm.dev.
- Help: Clients can reply HELP to any message for assistance.
- Data sharing: We do not sell, rent, or share phone numbers or SMS opt-in data with third parties for marketing purposes.

Intellectual Property
The Service, including its design, features, code, documentation, and branding, is owned by Pixie Dust CRM and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.
You retain ownership of all data and content you upload to the Service. By uploading content, you grant us a limited, non-exclusive license to host, store, and display that content solely for the purpose of providing the Service to you.
Agency Accounts
Agency accounts allow multiple travel advisors to collaborate under a shared agency. Agency owners and administrators are responsible for managing member access, permissions, and ensuring that all members comply with these Terms. We are not responsible for disputes between agency members. If an agency subscription lapses, access for all members may be suspended until payment is restored.
Third-Party Services
The Service integrates with third-party providers including, but not limited to, Stripe (payments), Firebase (authentication and data storage), Resend (email delivery), Twilio (SMS), and Evervault (card data encryption). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of any third-party service.
Service Availability and Modifications
We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice before making material changes that affect your use of the Service.
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIXIE DUST CRM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Indemnification
You agree to indemnify, defend, and hold harmless Pixie Dust CRM and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may terminate your account at any time by contacting us or through the account settings within the Service. Upon termination:
- Your right to access and use the Service will immediately cease.
- We will delete or anonymize your personal data within 30 days, subject to any legal retention requirements.
- Any outstanding fees owed prior to termination remain payable.
- Provisions of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) will survive.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Florida.
Changes to These Terms
We reserve the right to update these Terms at any time. When we make material changes, we will notify you by posting the revised Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid or unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable.
